Derivatives are the crucial and priority area of my legal practice. I offer comprehensive services on all related issues to banks, financial institutions and entrepreneurs.

Knowing what makes the markets go round and understanding the mechanisms driving the counterparties to conclude derivative transactions allows me to move smoothly and safely within the complex and changing regulatory environment. This requires not only the legal knowledge but also being aware of the range of risks involved in the existing or intended activities in the financial market.

I advise on both OTC (over-the-counter) and regulated market transactions and on all asset classes (interest rates, currencies, securities, commodities, energy, emission allowances, credit risk). I am well versed in all existing types of documentation for derivative transactions in the market. I am the author or co-author of the successive model documentation of the Polish Bank Association (including the 2003 Framework Agreement, the 2011 Framework Agreement, the 2017 Collateral Agreement – Variation Margin and the 2018 Initial Margin Agreement). I have unrivalled experience on the Polish market in negotiating ISDA (International Swaps and Derivatives Association) documentation.  

I draft legal opinions on the enforceability of netting with respect to derivative and collateral arrangements. I conduct documentation audits and prepare opinions or reports on compliance of the documentary provisions with the regulatory requirements (including in relation to EMIR, MIFIR/MIFID, CRR, BRRD and BMR).
